Terms & Conditions
1. Agreement to the Terms and Conditions
By using the services of The Custom Papers, you agree to comply with and be bound by the terms and conditions outlined below. Our company reserves the right to amend, update, or modify these terms at any time without prior notice to visitors or existing customers. Visitors are required to review this page regularly to stay informed of our current policies.
This website is intended solely for human use and may not be accessed or monitored by robots or other automated means. Fraudulent use of our website or any misleading activities that do not conform to these terms of service will be prosecuted to the fullest extent of the law.
2. Trademarks, Copyrights, and Customer Content
Content Ownership and Intellectual Property
When you submit artwork to The Custom Papers, you accept full legal responsibility for all content within that file. By submitting your designs, you warrant that you will not include any text, image, design, trademark, service mark, or copyrighted material belonging to a third party unless you have explicit authorization. The content printed on your materials should be unique and directly associated with your brand identity. Using copyrighted or trademarked elements without permission can subject you to severe legal consequences.
Limitation of Liability for Customer Content
The content, text, and graphics printed on your custom packaging depend entirely on what you provide. You are solely responsible for both the factual accuracy and the legal context of your submitted files. The Custom Papers and its departments shall not be held liable for design errors, text mistakes, or copyright infringements present in customer-supplied files.
While we utilize advanced technology and secure protocols to safeguard your personal data (as detailed in our Privacy Policy), customers must maintain strict quality control over the assets they submit for production.
3. The Purchase and Manufacturing Cycle
To ensure a seamless experience, our workflow follows these distinct stages:
- Order Confirmation
- Order and Design Approval
- Order Payment Process
- Order Design & Manufacturing Process
The Order Process
To place an order with The Custom Papers, customers must first fill out our online quote form. This form allows you to submit your detailed queries, dimensions, material preferences, and specific custom requirements directly to our packaging specialists.
Color Variations in Design
The Custom Papers prints directly from your submitted, print-ready files and utilizes high-performance equipment to match your design as closely as possible. However, due to the inherent constraints of commercial printing processes and varying digital color codes, we cannot guarantee an exact match for color density or hue. Final color output can be influenced by the texture and properties of different printing substrates, as well as the ink requirements of neighboring images.
Artwork Submission Guidelines
Upon receiving your files, our design team will generate a digital electronic proof for your review. To ensure high-quality print production, all submitted artwork files must have a minimum resolution of 300 DPI (dots per inch), be scaled to the final required dimensions, and be formatted strictly in the CMYK color mode.
4. Proofing, Approval, and Materials
Customer Responsibility for Layouts
The customer is entirely responsible for proofreading and verifying all text, layouts, and graphics submitted to The Custom Papers. We are not liable for errors, omissions, or structural mistakes present in customer-supplied artwork. Please thoroughly check spelling, grammar, and alignment before granting final approval.
Approval Prior to Printing
Production only begins after receiving explicit design and structural approval from the customer. Once this approval is given, the file is locked into the manufacturing queue. Any subsequent changes requested by the customer will incur extra administrative and processing charges. The Custom Papers reserves the right to reject any design asset that fails to meet basic quality standards or is deemed legally inappropriate.
Color Accuracy and Hardcopy Proofs
Because digital monitors calibrate colors differently, slight variations can occur between your screen and the final printed stock. For projects requiring strict color fidelity, we highly recommend that the customer requests and provides a physical hardcopy proof of the desired color match prior to mass production.
Structural Materials
We utilize premium-grade materials to guarantee structural durability and visual appeal. We offer a wide selection of top-tier stocks. Please note that the final performance of the packaging can be influenced by storage environment, temperature, and handling conditions. Upgrading to specialized material weights or finishes will incur additional charges on the final invoice.
5. Financial and Shipping Policies
Payment Currency and Gateways
All financial transactions with The Custom Papers are processed in Canadian Dollars (CAD). Depending on your specific order specifications, full payment—inclusive of all manufacturing costs, applicable provincial/federal taxes, shipping fees, and handling charges—must be cleared before production begins.
We accept secure payments through the following gateways:
- Credit Card / Debit Card
- Stripe
- PayPal
- Google Pay
- Apple Pay
- American Express
- Link
Manufacturing Adjustments
Once an order has cleared the approval stage and moved into our active designing and manufacturing pipeline, the order details are locked, and no structural or graphical alterations can be made to any part of the product.
Delivery and Shipping
We are dedicated to fulfilling orders within our standard estimated turnaround times, which typically range from 4 to 6 business days. However, delivery timelines may vary based on order volume, structural complexity, or unexpected transit conditions. Our team will notify you promptly of any anticipated logistical delays.
Customers must ensure that their submitted shipping address is accurate and complete. The Custom Papers is not liable for packages that are lost or damaged due to courier errors or incorrect addresses.
6. Order Cancellation
Customers are granted a 4-hour window following order confirmation to submit modifications or cancellation requests. Beyond this 4-hour threshold, The Custom Papers Canada bears no liability for accommodating adjustments, as resources are automatically allocated to the project.
- Cancellations between 4 and 24 hours: If an order cancellation request is submitted after the initial 4 hours but within 24 hours of placement, it will incur a 20% administrative deduction from the total paid amount to cover processing and workflow disruptions.
- Cancellations after 24 hours: Any cancellation request made after 24 hours will incur a 50% deduction of the total order amount. This fee compensates for the specialized design, material prep, and labor resources that are deployed immediately after the initial processing phase.
7. Production Tolerances and Holidays
Overruns and Underruns
While we aim to manufacture exact quantities, automated high-volume production can occasionally yield a minor discrepancy in the final unit count. The Custom Papers will typically deliver your exact ordered amount, frequently including a few extra complimentary units (especially on bulk runs) at no additional charge. Underruns are exceptionally rare; however, we strongly advise ordering 5% to 10% extra quantity to completely mitigate the risk of minor piece-count variances.
Statutory Holidays Observed
Our production facilities and customer support channels will be closed or operate on a holiday schedule during the following periods:
- New Year’s Day
- Good Friday
- Easter Monday
- St. Patrick’s Day
- Victoria Day / National Patriots’ Day
- Canada Day
- Labour Day
- Thanksgiving Day
- Christmas Day
- Boxing Day
8. Legal Disclaimers and Indemnification
Indemnification
You agree to defend, indemnify, and hold harmless The Custom Papers, its directors, officers, employees, representatives, vendors, and subcontractors from and against any claims, losses, damages, liabilities, or legal expenses (including reasonable attorney fees) arising out of or relating to a third-party claim that:
- The printing performed or product manufactured according to your specifications infringes upon any copyright, patent, trademark, or proprietary right of any individual or entity.
- The customer-supplied text or imagery is libelous, slanderous, defamatory, or legally obscene.
- Arises from unauthorized or malicious user access to password-protected areas of our digital platform.
Disclaimer of Warranty
The Custom Papers provides its manufacturing and digital services on an “as is” basis without explicit or implied warranties. However, our experienced packaging consultants and rigorous quality assurance teams work diligently to ensure your final order is completely free of structural, material, or printing defects.
